EVENT TERMS AND CONDITIONS

These Event Terms and Conditions (these “Terms”) apply to each event that is hosted or sponsored by Watch Nebula LLC ("Nebula", "we", "our", or "us"), where these Terms are referenced in connection with registration, admission purchase, on an admission pass, or otherwise (each, an “Event”).

By registering for an Event, purchasing a ticket for an Event, or by attending an Event, you agree to the following: 

LICENSE TO ATTEND

A ticket or admission pass grants a revocable license to attend the Event. Nebula reserves the right to refuse entry or remove any individual for disruptive behavior, violation of rules, noncompliance with staff instructions, or otherwise. You may be required to present identification upon admission. 

ALL SALES FINAL

All sales are final. No refunds or exchanges will be permitted.

ASSUMPTION OF RISK

Attendees assume all risks incidental to the Event, including personal injury, property loss, or illness (including but not limited to COVID-19 exposure). You release Nebula and its affiliates from any damage or harm to persons or property in connection with the Event. 

LENGTHY RECORDING PROHIBITED

Use of recording devices, cameras, or cell phones to record more than five (5) consecutive minutes of the Event is strictly prohibited. Violations may result in ejection and legal action. 

PHOTOGRAPHY & MEDIA RELEASE

By attending the Event you acknowledge and agree that Nebula and its appointees may record, film, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.

VENUE POLICIES & SEARCHES 

You agree to comply with any and all rules and policies imposed by the venue where the Event is held, and may be subject to bag checks or screening. Refusal may result in denied entry to the Event without a refund.

FORCE MAJEURE

Nebula is not responsible for delays or cancellations due to circumstances beyond its control, including weather, technical issues, or public health emergencies.

LIMITATION OF LIABILITY

THE EVENT IS PRESENTED ON AN ‘AS IS’ BASIS, AND NEBULA DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE EVENT. NEBULA AND ITS AFFILIATES AND THEIR VENDORS SHALL NOT BE LIABLE TO ANY PERSON OR ENTITY FOR ANY INDIRECT LOSS, DAMAGE (WHETHER ACTUAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, OR OTHERWISE), INJURY, CLAIM, OR LIABILITY OF ANY KIND OR CHARACTER WHATSOEVER RELATING TO OR RESULTING FROM THE EVENT. IN NO EVENT WILL NEBULA’S TOTAL LIABILITY TO YOU RELATING TO THE EVENT EXCEED THE AMOUNTS PAID FOR YOUR ADMISSION TO THE EVENT. CERTAIN PROVISIONS OF THIS PARAGRAPH MAY NOT APPLY TO CONSUMERS WITHIN JURISDICTIONS WHERE PROHIBITED BY LAW.

DISPUTE RESOLUTION 

In the event that our Customer Service team is unable to resolve your concern, any disputes arising out of these Terms or the Event will be resolved entirely through binding confidential arbitration in New York, New York. Arbitration shall be conducted under the rules then prevailing of the American Arbitration Association (AAA). The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

To begin an arbitration proceeding, you may send a letter requesting arbitration and describing your claim to: Watch Nebula LLC, PO Box 5426, Denver, CO 80217-0009

We each agree to bring any dispute in arbitration on an individual basis only, and not on a class, consolidated, representative, or collective action basis. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial or to participate in a class action against the other.

THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN THE AAA RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT YOU OR NEBULA WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION.

APPLICABLE LAW

The law applicable to the interpretation and construction of these Terms shall be the Federal Arbitration Act, applicable federal laws, and the laws of the State of New York, USA, without regard to principles of conflict of laws, but subject to the Federal Arbitration Act and other federal law relating to the arbitrability of claims. You agree that all matters relating to the Event, including all disputes, will be governed by the laws of the United States and by the laws of the State of New York.

GENERAL TERMS

We reserve the right to make changes to these Terms, at any time without notice, from time to time at our sole discretion. All terms and conditions are applicable to the extent permitted by law. If any of these terms and conditions are deemed invalid, void, or for any reason unenforceable, that term and condition shall be deemed severable and will not affect the validity and enforceability of any remaining terms or conditions.
